For the above listed plans, spousal consent forms will be required for all distributions and loans for married participants. If their status on record indicates that they are single, we will add a DMC alert to advise that no spousal consent form is needed. If their status on record indicates that they are married, we will need to reach out to request that their spouse completes the required form before the request can be processed.


You will need to send an email to the participant with the J&S form attached (canned response available, see FD 845524 for example of communication) and note the PC record with the FreshDesk ticket number. The PC record should also be updated to ensure automated notifications are sent out to the participant, example below:



If we are missing a marital status on file for participants in the Americas 403b PEP and Ameritas 403(b) PEP plans, we are required to reach out to the participant to request confirmation of the marital status. If married, the spouse will need to sign the form per our regular procedure but if they are single, they will need to notate the spousal consent form that they are single and still have this notarized. This is a requirement by the plan administrator that we receive their written confirmation of being single.


For Pasco, South Florida, Bay Area, or Menorah Manor participants that are missing a marital status on file, we will be required to reach out to the account manager assigned so that they may confirm the participant's marital status with the employer. Even if a participant is terminated, they are required to maintain this information.
